Life as a process server can swing on a pendulum from average—even mundane—to a little bit too exciting. When presenting subjects with the papers that need to be served, you may find yourself in a situation that’s difficult to navigate due to a less-than-friendly recipient. Some shout words and nothing more, but others take things to the next level. How exactly should you react, and what do you say to the police?
If the Subject Makes a Threat
Many people are willing to call the police in an effort to avoid hearing the words “you’ve been served.” If a subject begins making such threats and demanding that you leave, it’s best to step off the property, but still wait for the police officer to arrive so the officer can hear your perspective of the situation as well. Police offers are often sympathetic to process servers and willing to help out, and the officer’s statement can serve as a solid affidavit that you attempted service.
If the Subject Claims Trespassing
Even if it’s not true, you still need to leave. Regardless of your legitimate purpose on the subject’s property, trespassing can still be pursued as a criminal offense. At that point, it’s time to get creative!
If the Subject Becomes Violent
You obviously don’t want to be forced to return the violence, but you do need to defend yourself enough to safely leave the property and call the police. Give your full statement with honesty and you’ll have nothing to worry about.
Many process servers don’t choose this field because it’s easy, but rather because each recipient is like a puzzle that needs to be solved. Delivering papers without any drama, violence, or screaming can feel like a delicate balancing act and creative problem solving simultaneously.
