What Does a Process Server Do?

Process servers play an essential role in the American legal system. Here in Florida, process servers have an even more vital role, as process served in Florida may only be served by either law enforcement or a certified private process. With law enforcement already overworked, it often makes more sense to hire a private process server.

Process servers deliver court documents

Process servers deliver court case-related paperwork to its intended recipient, which is usually a defendant, witness, or other party involved in the case. This paperwork is collectively called process. Process servers serve process by locating the intended recipient and handing them the paperwork, typically in person. If the process server cannot locate the intended recipient to deliver the papers in hand, the court may allow the process server to deliver the paperwork via mail, in-person to another responsible party, or by publishing it in the local newspaper. Once the process server has satisfied the state’s requirements for service, the recipient is considered to be served and the legal case will be heard by a judge on the scheduled date.

Common court documents that process servers deliver include:

  • Summons
  • Complaints
  • Motions
  • Subpoenas
  • Orders
  • Writs

Process servers uphold our rights

Why must each person involved in a legal case be served according to legal guidelines? Well, it is a matter of constitutional rights.
